What Is the Difference Between Record Sealing & Expungement in Colorado?

The difference between expunging and sealing a record is that expungement makes it as if the record does not exist. Sealing a record simply prevents most parties from accessing your record. For instance, employers and landlords would not be able to see a sealed record, protecting your reputation when applying for a job or housing. In Colorado, only juvenile records are eligible for expungement.

Juvenile records are eligible for expungement if:

• They have been acquitted of the charge
• They got through a juvenile diversion program
• They have not been convicted of an aggravated or violent crime
• They do not commit any more offenses after the incident

If you are an adult and were not convicted, you may only have your records sealed. This includes situations where charges were dismissed or charges were not filed. Even then, there may be some circumstances that require you to wait to seal your records. For example, if your case was dismissed as a result of a plea agreement, your records may not be sealed for 10 years.
